Lawyers to find out if personal injury rate decision to be revised

At the moment personal injury lawyers are waiting to find out whether the government has decided to alter the rate of discount which is currently applied when damages are awarded.

The rate previously stood at 2.5% but was revised to -0.75% by Liz Truss who was Lord Chancellor at the time. This moved was criticised by people, including Conservative peer Lord Hodson, who described the amendment as “draconian”. A consultation about the rate, which finished in May this year, garnered 135 responses, but to date there has not been any indication what the government’s response to this will be.

Justice Minister, Lord Keen of Elgie stated in the Law Society Gazette that: ‘'An announcement of the government’s conclusions will be made at the earliest possible opportunity. Of course, the interests of all parties concerned will be considered, and there will be an impact assessment.” He also stressed that the consultation was carried out in order to establish a “better and fairer system for claimants and defendants” resulting in them being paid “no more but no less than they should be”. It is expected that a government announcement will be made regarding the consultation at the start of August.
